This was not going to be my tip in the recently published book "The Magnificent 7" which you can download for free HERE. I was set to tip Optibiotix (OPTI) at c40p. Unfortunately for you (but fortunately for me since we own shares in the company) the share price has raced ahead to a 48p offer. I still think that they could head much higher and Zak Mir reckons that Optibiotix shares will be 60p by October. I think, that is what a chartist terms a long term view.

Risky ……… I think they are going to get a good kicking in court and thats why the share price is low . Expecting to compromise out of court is the give away that there is some substance to the claim. You could easily wake up one morning and find you have been wiped out. Patents are like that .

spent 4.5 mill for 150k of income and a law suit with a 500k provision . 2.5 mill left in the bank and comments give away the fact that the law suit may have some merit .

Ah yes ! but lets never let a few facts get in the way of a good thrashing ! Its just like John Cleese beating an Austin 1100 with a tree branch , or the whole of the SP staffers cascading their wrath down on my beloved LGO ;-) . I quite agree , just checking your all awake up there in SP Towers , via a poke with a very long stick ……… sorry could not resist it . Neither could the market by the look of it ! A loss of 4p a share translates into ……. a share price that has only dropped 2.5p , So far .

Oh dear – results were a little poor I think. Clearly the patent case is having a chilling effect on contract wins. The only silver lining was some inference that there are markets unaffected by the patent – which ones? Also that they are busy spending lots of money in R&D on a new oncology diagnostic – with no information. Clearly they are going to run our of money well before the hearing date predict of Oct 2016 – and the judge will not issue his decision until probably December 2016. It does not look good.
Two rabbits need to come out of the hat
1. More contracts – of substance with some guidance on revenue
2. More information on “jam tomorrow” sorry I mean the R&D pipeline

Yes I listened to the bearcast and yep you are right an oversubscribed placing in July @20p is positive (except the 20% dilution) – so perhaps they saw something that we cant see. As I cant see whatever it was the folks in July can see then how can I decide? A promise of contracts in next 2 months is rumour and not news. Cash in bank 5,238,614 as of 30 Sept – is it enough? Surely some trimmings in the expenditure and a rise in the income needed? BTW a provision of 0.5m for the patent litigation is not enough – unless
1. they have already accounted a likelihood of a win and the court awarding their fees (and the 0.5m is an estimate of the amount that cant be recovered + the factor applied as to chance of a win). If they lose they will also be liable for Illumina costs – so this tels me at least that the patent attorney has convinced the accountants that they are likely to be successful. That isn’t hard all teh accountant needs is a letter (something like this “I believe a well informed court reviewing the case will decide that the patent will be held invalid”) But then the patent attorney is the one trousering the fees and wins regardless of the outcome – unless on a conditional fee arrangement –
2) a CFA might also explain the 0.5 – this is more positive as the patent attorney is putting some money behind it – for an uplift on a win.
