The Sunday Times today carries some but not all of the story of how Rob Terry of Quindell (QPP) forced Canaccord to gag and then fire its star analyst Kevin Ashton. In this podcast I give you the full story and the questions it raises mainly for Canaccord. Its reputation is now in tatters and it has serious questions now to answer. It needs to come clean

You tell us that much of what Kevin wrote in his report showed up in the Gotham report. The Gotham report has been discredited in court. Therefore by extension, the items that were the same in Kevin’s report have also been discredited in court. You tell us that there were other things that Kevin wrote that were not in the Gotham report, but you fail to tell us what these things are. You tell us that the reason Quindell does not take you to court is becasuse they have something to hide. Gotham did not defend themselves in court. Presumably because they have nothing to hide? You are starting to tie yourself in knots now. Your spin on this story just went the other way. Please feel free to abuse me with your usual foul and obnoxious language, it is after all the thing you do best.

The Gotham report was not discredited in Court. Gotham used the Speech Act as a pergectly senisible defence, QPP declined to sue in the US ( AS IT SAID IT WOULD DO).
QPP’s response to Gotham was pitiful.
QPP are still not suing me despite promising to do so because they know they will lose.
You need a fact check my friend

Quindell are back in court this Thursday (27th November, 2pm, Master Eastman, Royal Court of Justice, the Strand). It is a public hearing, so why not go along, Mark?
Rob Terry and his Mrs are suing Gotham for the loss in their share price. Even though Gotham aren’t there, they are still under an obligation not to mislead the court and to point out any particular defects of which they are aware in their own case.
I wonder if Rob will point out to the court that he – through his own volition – failed to get a premium listing despite saying he would, and that this news dropped the SP. Or that he – despite his upbeat statements otherwise – could not complete his side of the bargain on the RAC deal which was then dropped. Or that he sold his shares to EFH and pretended it was a buy?
Because of course if the share price would have dropped anyway – because of those things – he can hardly blame Gotham for them, he can only blame himself!
Also, even more interestingly, QPP itself is suing. It is stating that the reduced share price has harmed its business. How so? Cal and Dan from the Red Lion putting in a hearing loss claim cos the salesman told them it’s £5,000 guaranteed couldn’t give a flying toss about the share price. ABC Plastering, who hire a Quindell scaffolding for an external render job in Southampton also don’t care about the share price.
The only way a depressed share price could effect QPPs business is if QPP are in desperate need of a placing to raise further cash.
Shurely shome mishtake?
nigel somerville
Dominic – not to mention the possibility that one or more of QPP’s subsidiaries could still have shares in QPP on the books which they may have wanted to sell in the market (and not, therefore, necessarily place out). Or perhaps talk to EFH about!

@Mark. Can’t believe your statement. So the Gotham report was discredited – mine was not published and will never be available – well at the FCA investigation maybe. The stock is down 90% or so from the Gotham thang and you think the Gotham report is discredited? I’m not sure what you do for a living but 90% for an investor is a “bad thing”. If warning investor they are about to lose 90% from their piggy bank is in anyway discreditable then I’m a monkeys uncle and probably just the arse hole section of a monkeys uncle. Jeeeeeez.
