Bad news for AIM - Class Action against Cantor Fitzgerald re African Potash fraud fails to get off the ground

2019-01-26 04:11:18

African Potash (AFPO) released 2 RNS statements about claimed deals in Southern Africa,. The shares raced ahead. Nomad Cantor Fitzgerald and its QE Mr Stuart Dick signed off on those RNS statements but cannot have bothered to check the original documentation about those deals. Because I got hold of that documentation & published it and that showed the RNS's were misleading. But they caused a share spike allowing a bailout placing to go ahead.

Stuttard’s Septic Seven – August update and news from African Potash

2017-08-20 03:29:52

It is August and Marcus Stuttard, the head of AIM, sees his portfolio of AIM stocks selected for him get to within 40 days of a full year. Out of the seven three have been booted off the market, one is suspended (no accounts) and the other was booted off AIM but got listed on the NEX lobster pot until it was suspended on that market as well. But Mr Stuttard is completely happy with the regulatory environment of the world’s most successful growth market.

BREAKING: African Potash FRAUD - Nomad Cantors will be sued by 3 investors - case gets green light (Cloudtag next!)

This has massive implications for the AIM Casino. We saw last week that the London Stock Exchange was washing its hands of tackling Nomads who sign off on frauds and so allow investors to lose all their cash to shysters. Now the private sector moves in. I can reveal today that Cantor Fitzgerald will be sued by investors who lost money on the African Potash (AFPO) fraud because it was negligent in signing off on fraudulent releases. If this case wins the floodgates are open...

African Potash - will the fraud be thrown off NEX on Monday or will the establishment bend the rules for Lord Hain of Sleaze?

To be thrown off one market because your adviser tired of signing off on lies is understandable, if you are a fucktard in AIM Regulation who does not care about fraud. But, to paraphrase my fellow Anglo Irishman Mr Wilde, to be thrown off two markets for that reason looks like carelessness. And that brings us to the fraud African Potash (AFPO).

You would have thought that having not one but two advisers resign because they would not sign off on its lies, being out of cash, having its shares suspended on NEX after being slung off AIM would be enough to kill African Potash (AFPO). The weasel words of lyin Chris Cleverley reviewed as FRAUD African Potash booted off AIM

2017-01-09 02:15:30

The fraud African Potash (AFPO) has been formally booted off AIM today as no Nomad is prepared to act for it. It is a day of shame for lyin Chris Cleverley the CEO and his senior NED Lord Peter Hain of sleaze. The shares are now only listed in the joke lobster pot that is NEX Markets, it is almost impossible to sell in any size and even harder to raise cash as a company. So Potash will soon go bust. At the weekend I explained the very odd timeline of seven days in September that lead up to the last Nomad, Cantor Fitzgerald, quitting. Now look at lyin' Chris's words since.

You may well remember that one of the frauds committed by African Potash (AFPO) in November 2015 was the announcement of a ramptastic deal with Beryl Holdings. The company announced all the good bits ( which as it happens failed completely to materialise in any way shape or form) but neglected to mention a £600,000 bung it had agreed to pay to Beryl. African Potash Accounts finally out - damning statements by RSM Tenon auditor

2017-01-03 03:00:29

I am yet to get an explanation from Peterhouse Corporate Finance, the advisor to ISDX and (pro tem) AIM listed fraud African Potash (AFPO) as to why accounts for the year to June 30 were signed off on 28 December but not released until 3 hours and 48 minutes after the stockmarket closed for a three day New Year break on 30 December. This is surely a breach of ISDX rules and it shows, again, that the fraudsters are prize rotters. Why is Peterhouse not resigning NOW? But it gets worse, the actual, annual report was promised by 31 December but has only this morning appeared on the company's ramptastic website. Why the delay? How about not wishing to admit to damning comments from auditors RSM Tenon which show that this company is toast? The auditor does not mince its words.

And thus Cantor Fitzgerald has today said it is resigning as Nomad to the fraud African Potash (AFPO) - which is still not suing me for libel despite promising to do so on September 1st if I did not cease calling it a fraud and pay it £2,000. GOTCHA Potash: you are still a fucking FRAUD now where's that libel letter you bastards? I want to see you fraudster bitchez in Court so badly. So what's going on here. One broker summed it up brilliantly today:

African Potash – AIM Rule 26 page updated: where has joint broker Cornhill gone?

So having pointed out that AIM-listed and under-the-Sheriff’s-spotlight African Potash (AFPO) was in slam dunk breach of AIM Rule 26 by naming the wrong brokerage as its joint broker (actually the one named closed down at the start of this year), and incorrectly naming its Auditor, the company has got around to getting things up to date. And so we can now see that it has one joint broker in the form of its Nomad, Cantor Fitzgerald. So what happened to the other joint broker, Cornhill? Has it resigned? I think (and AIM Rules dictate) that we should be told.

African Potash, libel and disclosure - let's start with payments made to Beryl

As yet African Potash (AFPO) has not started the process of suing me for libel for pointing out that it committed securities fraud, something it effectively conceded it had done in its fascist lawyers letter/suicide note of last week. One of the joys of the UK libel system is disclosure. That is a process where I can ask the other side to produce certain documents which are relevant to the case. And African Potash knows that disclosure will sink it for good. So let's bring it on and I shall be starting with seeking details of payments made by Potash to Beryl Holdings.

African Potash – Nomad Cantor Fitzgerald has grave questions for its compliance officer to answer

2016-09-05 03:19:15

I read with alarm the deluge of shocking revelations regarding AIM-listed African Potash (AFPO) from the Sheriff of AIM, Tom Winnifrith. The most recent – and possibly most surreal – development was the lawyers’ letter from the twice-bitten-but-still-not-shy Memery Crystal on behalf of its client, Potash. Tom Winnifrith has already suggested that the letter makes a number of stunning admissions, but in my view the implications of the African Potash affair for Nomad Cantor Fitzgerald Europe need to be addressed urgently.

African Potash and AIM Rule 26. Does Nomad Cantor Fitzgerald give a fig for it responsibilities?

Oh dear. It seems that we have a slam-dunk breach of AIM Rules in the form of extremely honest Chris Cleverly’s AIM-listed African Potash AIM and its dealings with its Nomad Cantor Fitzgerald. It is Cantor and its lead QE Stewart Dickson who are in the spotlight today as we have at least 1 clear rule breach under its watch to report. We will start with a minor transgression and work upwards. Perhaps while Marcus Stuttard’s oxymorons at AIM Regulation consider the serious content of Tom Winnifrith’s recent missive (HERE) they might turn their attention to the quality of Nomad oversight demonstrated in what follows.

Marcus Stuttard of AIM Regulation: African Potash admits to fraud - will you please act?

2016-09-02 06:48:31

I have today published the lawyers letter sent by Memery Crystal - lawyers to Globo - but which also acts for the fraudsters African Potash (AFPO) demanding money from me, trying to gag me but also admitting that its client has committed securities fraud. The letter also implies that Nomad Cantor Fitzgerald approved releases (and lack of releases) which meant investors in a placing on 12 January 2016 were utterly deceived as to the trading position at Potash. And that is a clear cut case of fraud. But will Marcus Stuttard, the head of AIM Regulation do anything about it or is fraud now acceptable on AIM? I have written to the man who basks in the title "The Sheriff of AIM" as you can see below.

African Potash - 2 days to find $1.1 million: an open letter to Lord Peter Hain

2016-08-30 00:39:58

In two days time African Potash (AFPO) must repay its finance director's wife $1.1 million as it is obliged to clear the most expensive loan in AIM history. It has no cash so prepare for mega dilution as the loan will be repaid in shares at 0.29p per share, or lower. Against that background I have, this weekend, shown that on both January 6 2016 and December 1 2015 it lied to investors ahead of its last bailout placing, it engaged in fraud. The man charged with holding CEO lyin' Chris Cleverley to account on this is perma-tango tanned Labour Lord, Peter Hain. I have written to his Lordship today.

I have already requested that the FCA and AIM Regulation investigate the deliberate way that investors were misled by African Potash PLC (AFPO) ahead of the January 12 2016 bailout placing with an RNS on December 1 2015 as you can see here. Now evidence is emerging of an even bigger deception in an RNS on January 6 2016 just six days before a bailout placing. I have thus written to both the FCA and AIM Regulation asking both to widen their investigation into both Potash and also Nomad Cantor Fitzgerald and its lead QE, Mr Stewart Dickson. This is a clear case of Securities fraud.

That should be enough to see the authorities slam both Potash and Stewart Dickson et al at Nomad Cantor Fitzgerald. But it gets worse. AIM-quoted African Potash (AFPO) has paid some £70,000 for a 4.74% stake in fellow AIM counter and specialist investment group  Blenheim Natural Resources (BNR) as part of its declared policy of participating as fully as it can in what chairman Chris Cleverly argues remains one of the fastest growing sectors in the world. African Potash, which combines a role in sourcing and supplying potash, a key source for fertiliser, with the 1.7 billion-tonne Lac Dinga potash mining project in the West African  Republic of Congo, is contributing to a £640,000 placing at a lowly 0.8p by Blenheim, whose backers include veteran resources investor Bruce Rowan and seasoned plantations player and director Konrad Legg.

Fertiliser play African Potash (AFPO) has fixed funding arrangements to carry out its latest $100 million (£65 million) of supply deals and recruited two former government ministers to its board. African-born Lord Hain, former Labour cabinet minister and as Peter Hain a past leader of campaigns against South African apartheid, is becoming a non-executive director of the AIM-quoted company, which is also bringing Mark Simmonds, recently Conservative Foreign Office Minister for Africa, onto the board.

Pricing deal cheer at African Potash

2015-09-28 00:25:48

AIM-quoted African Potash (AFPO) has agreed a price of $500 (£329) a tonne for 50,000 tonnes of potash-based fertiliser material it has agreed to supply to the Zambian market under a recent Memorandum of Understanding (MOU) in a deal which Dr Chris Cleverly, the company’s executive chairman, suggests will deliver an expected pre-tax profit margin of 6%. The price compares with recent market prices of around $300 a tonne and is higher than many were expecting for this deal.

African Potash; delivering on its promise

2015-09-25 04:12:32

This morning, African Potash (AFPO) announced the $500 sales price per metric tonne of the fertiliser it is contracted to deliver to a distributor in Zambia. Under the terms of this contract, African Potash must deliver 50,000 metric tonnes (MT) of fertiliser by 24 August next year. The company expects a pre-tax profit margin of 6%, equalling $1.5million, assuming all goes to plan. African Potash’s share price is up 9.47% to 3.12p, last seen. If the company can agree similar terms across in its other deals, it could carve out for itself a very profitable niche in Africa’s burgeoning agricultural sector.

African Potash leaps on a very vague RNS

2015-08-06 01:34:10

The share price of African Potash (AFPO) rocketed this week on news that it was moving into the fertiliser trading market. Previously the company has focused on its Lac Dinga project in the Congo, where initial drilling last year revealed the presence of significant potash deposits. But now, in the shorter term, it looks as though the tiny AIM-listed company will be shifting its focus to sourcing fertiliser from producers to then sell on, earning a cut of the proceeds for acting as the middle man.

African Potash – encouraging news for its long term future

2015-06-12 06:23:56

Encouraging news this morning from African Potash (AFPO) has been greeted with a collective shrug of the shoulders from a sceptical market. As part of its planned strategy for expansion, African Potash has entered into commercial discussions with an agency of the Common Market for Eastern and Southern Africa (COMESA). COMESA is a free trade union for twenty African Member states and, if fruitful, African Potash’s discussions could lead to the development of a clearly defined sales channel for its potash-based fertiliser products across that continent.

African Potash; A NEW forward selling case involving Cornhill Capital?

2015-05-27 02:16:45

Hot on the heels of the New World Oil & Gas (NEW) fiasco, evidence is emerging of a separate incident of possible forward selling of a placement involving another client of Cornhill Capital. Was this all above board? African Potash (AFPO) announced its plan to raise £1.2million on April 17th. In an echo of the New World controversy, African Potash’s placement was partially dependent on a successful shareholder vote at an EGM on May 21st.  Careful analysis of African Potash’s daily volume data, before and after April 17th, reveals a number of troubling questions.

The company, whose shares have plunged from 4p to 0.47p in less than a year, holds 70% of the Lac Dinga potash project in the Kouilou region of the West African Republic of Congo -- not the strife-torn Democratic Republic of Congo --   and is seeking one or more strategic partners to develop it.

Drilling cheer for African Potash

2014-09-11 07:08:27

‘We have taken the risk off the table,’ asserts an enthusiastic Ed Marlow, chief executive officer of AIM-listed African Potash (AFPO), in the wake of encouraging early results from the first drill hole sunk by the company at its Lac Dinga potash project in the Republic of Congo’s Kouilou region. Exploration drill hole LDDH 001 has intercepted a 120 metre-thick salt sequence some 415 metres below surface, which includes a ‘critical’ 40 metres of multiple potash seams.

African Potash secures fertile funding deal

Ed Marlow, the former African investment chief at the HSBC banking group who now heads AIM-listed African Potash (AFPO), is waiting for first drilling results from the Guernsey-registered company’s Lac Dinga project in Republic of Congo, as he savours its success in obtaining $3.75 million (£2.2 million) funding for the project from US investment group Bergen Asset Management. Results from the first hole at Lac Dinga could come through in two weeks, he suggests, with data from the second hole hoped-for in September, ‘and then we’ll know how the nature of the deposit and how commercial it will be.’ Is this now a stock to consider?

African Potash offers large upside potential

2014-07-07 06:43:28

Potash isn’t exactly up there with more glamorous natural resources, like diamonds and gold, but is still valuable. African Potash poised to drill

Potash, the potassium-bearing material used to make fertiliser, may be arousing controversy in Yorkshire. Its price may also have slipped from $500 a tonne before the 2007 financial crash to nearer $325 today, thanks to the actions of Russian and other key cartel producers. However, AIM-quoted African Potash (AFPO), which the other day raised $1.7 million (£1.06 million) at a lowly 1.9p, will sign contracts imminently to start drilling at its Lac Dinga potash project in West Africa’s Republic of Congo; not the strife-torn Democratic Republic of Congo!
